The Architectural Control Committee

The Architectural Control Committee ("ACC") is a duly constituted committee of the Lake San Marcos Community Association.  It oversees Architectural Controls for those homes in the community which are not otherwise under the control of one of the 22 HOA's in the community. Most of the single family homes under this ACC are located on the east side of the lake around the country club or on one of the 4 malls. There are also some single family homes in the Highlands neighborhood which fall under our control.  If you are unsure which Architectural Control Committee your home is under, please contact either your HOA or the LSMCA office for clarification.

The ACC has established general guidelines for additions, remodels, and changes and/or alterations to properties in Lake San Marcos

1.      The structure proposed in detailed submitted plans by the applicant must comply with historically established architectural requirements.

 

2.      The structure, as proposed by the applicant, must not become an annoyance or nuisance to the neighborhood.

 

3.      All Lots shall at all times be kept in a clean, sightly and wholesome condition and no trash, garbage, litter, junk, boxes, containers, cans, machinery, implements, lumber or other building materials shall be permitted to be kept or remain exposed on any Lot and visible from any street or from adjoining or nearby premises.  The landscaping of the front yard and the exterior of the building shall be maintained in an attractive manner at all times.  No recreational vehicles or recreational equipment, whether permanent or temporary in nature, shall be placed or located on the streets, driveways or Lots.

 

4.      The exterior finish, the color and architectural style or character of the proposed structure must be deemed suitable in view of the architectural style and character of structures erected in the subject tract.

5.      The garage is designed to accommodate vehicles, not human occupancy.  Vehicle parking should be considered so as to not unnecessarily prohibit neighbors from enjoying use of the street for their guest parking and maintenance vehicles.  No vehicles of any sort shall be parked on any Lot except in a garage, a carport or a driveway.  Parking of vehicles in front yards is not allowed.

 

6.      Room additions require letters of approval from adjacent property owners so that existing views of the golf course, green belts, lake or other features are not adversely affected.  Depending on location, letters of approval may be required from owners who view the subject property from the rear of the property.

 

7.      If binding arbitration is commenced to enforce any of the covenants, conditions or restrictions contained in this Declaration, the party against whom the judgment, decree, order, declaration or determination is entered or issued shall, and agrees to, pay all costs of suit and reasonable attorneys´ fees, such as may be established by the arbitrator.



The Architectural Control Committee ("ACC") is a duly constituted committee of the Lake San Marcos Community Association who has vested in the ACC responsibility for interpreting, applying and enforcing the terms and conditions of those Declaration of Restrictions which apply to residential structures existing in the greater Lake San Marcos community.  The ACC has conducted a comprehensive review of the residential units which have been built and/or remodeled in accordance with the architectural standards established by clear and present example through historic custom and practice and by the existence of those structures which are the result of said custom and practice.  The ACC will enforce those architectural standards, which have been clearly in existence and have been consistently enforced since 1964.
